EPA to Revise Regulations for Clean Water Act Section 401

EPA appears determined to return significant authority back to States with respect to Clean Water Act Section 401. Taking such action could create significant delays for linear projects (e.g., transmission lines and pipelines) necessary for achieving the Biden administration's climate goals. It also could have serious practical and business implications for hydroelectric facilities and inland ports. Comments are due to EPA on August 2, 2021.
