On August 9, 2021, the National Marine Fisheries Service published its list of fisheries (“LOF”) for 2022 pursuant to the Marine Mammal Protection Act (“MMPA”). 86 Fed. Reg. 43,491. The MMPA requires NMFS to classify each commercial fishery on the LOF into one of three categories based on the mortality and serious injury of marine mammals incidental to each fishery’s operations. Depending on a fishery’s category, it may be subject to MMPA registration, observer coverage, and take reduction plan requirements.
