California Energy Commission Upgrades Energy Efficiency Standards

On August 11, 2021, the California Energy Commission adopted the 2022 Building Energy Efficiency Standards (“Energy Code”).  The Energy Code applies to newly constructed and renovated residential and commercial buildings.  The upgrades are intended to advance California’s public health, climate, and clean energy goals.   

Energy Code Changes

The Energy Code includes numerous changes. Many of the changes focus on accelerating electrification.  Several key changes include the following:

Electric Heat Pump Technology

The Energy Code includes electric heat pumps as a baseline technology.  The Commission found that electric heat pumps consume less energy and produce fewer emissions than gas-powered units.  Although not mandatory, new residential and commercial buildings that do not include electric heat pumps must comply with stricter energy efficiency requirements.

Electric-Ready Requirements

The Energy Code requires single-family homes to be equipped for electric heating and cooking as well as for electric vehicle charging. As with electric heat pumps, these changes are designed to create pathways for emissions reductions by increasing reliance on electricity produced from renewable energy sources and decreasing reliance on natural gas.

Solar Photovoltaic (PV) System and Battery Storage Standards

The Energy Code establishes combined solar PV and battery standards for certain businesses.  The purpose of these standards is “to maximize onsite use of solar energy and avoid electricity demand during times when the grid must use gas-powered plants.”

Energy Efficiency Standards for Commercial Greenhouses

The Energy Code imposes heightened energy efficiency standards for commercial greenhouses.  These provisions primarily will impact indoor and greenhouse cannabis growing operations.

 California Building Standards Commission

The Commission will now submit the Energy Code to the California Building Standards Commission for approval. If approved, the Energy Code would become effective January 1, 2023.
